Welcome to Vape Quit! These Terms of Service ("Terms") govern your access to and use of the Vape Quit mobile application and related services (collectively, the "Service") provided by FUTNext LTD ("we," "our," or "us").

By using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Acceptance of Terms

By creating an account, downloading, installing, or using the Vape Quit app, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You will provide accurate and complete information when creating an account
• You will maintain the security of your account credentials

3. Account Registration

3.1 Account Creation

To access certain features of the Service, you must create an account by providing:

• A valid email address

• Optional profile information

3.2 Account Security

You are responsible for:

• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

3.3 Account Termination

You may delete your account at any time through the app settings. We reserve the right to suspend or terminate your account if you violate these Terms.

4. Subscription and Payment Terms

4.1 Free Version

Vape Quit offers a free version with basic tracking features. The free version is provided "as is" with no guaranteed uptime or support.

4.2 Premium Subscription

Premium features are available through a paid subscription:

• Monthly Subscription: $3.99 per month
• Annual Subscription: $39.99 per year
• Free Trial: 7-day free trial for new users

4.3 Payment Processing

All payments are processed securely through third-party payment processors (Apple App Store, Google Play Store, or RevenueCat). Your payment information is subject to the privacy policies and terms of these third parties.

4.4 Automatic Renewal

Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. You will be charged through your App Store or Google Play account.

4.5 Cancellation

You may cancel your subscription at any time through:

• Your Apple App Store account settings (iOS)
• Your Google Play Store account settings (Android)
• The Vape Quit app settings

Cancellation takes effect at the end of the current billing period. No refunds are provided for partial subscription periods.

4.6 Price Changes

We reserve the right to modify subscription prices with 30 days' notice. Price changes will not affect your current subscription period but will apply upon renewal.

5. Refund Policy

5.1 Free Trial

You may cancel your subscription during the 7-day free trial period without being charged.

5.2 Subscription Refunds

All subscription payments are non-refundable except:

• Technical issues that prevent you from accessing the Service for more than 7 consecutive days
• Accidental duplicate charges
• Unauthorized charges
• As required by applicable law

5.3 Refund Requests

To request a refund for eligible circumstances, contact us at [email protected] within 14 days of the charge.

6. Use of the Service

6.1 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes.

6.2 Restrictions

You agree NOT to:

• Modify, adapt, or create derivative works
• Use the Service for any illegal or unauthorized purpose
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any systems or data
• Use automated scripts or bots to access the Service
• Share your account credentials with others
• Resell or redistribute the Service
• Remove or alter any copyright, trademark, or proprietary notices

7. Health Disclaimer and Limitations

7.1 Not Medical Advice

Vape Quit is a self-help tool and behavior tracking application. It does NOT provide medical advice, diagnosis, or treatment. The information provided through the Service is for educational and informational purposes only.

7.2 Consult Healthcare Professionals

Before making any decisions based on information from the Service, consult with a qualified healthcare professional. Nicotine addiction is a serious medical condition that may require professional intervention.

7.3 No Guarantees

We make no guarantees about:

• Your ability to quit vaping using the Service
• The accuracy of health metrics or predictions
• Timeframes for health improvements
• Individual results (results may vary)

7.4 Emergency Situations

If you experience a medical emergency related to nicotine withdrawal or otherwise, call your local emergency services immediately. Do not rely on the Service for emergency assistance.

8. Intellectual Property Rights

8.1 Ownership

The Service, including all content, features, functionality, software, and design, is owned by FUTNext LTD and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8.2 Trademarks

"Vape Quit" and associated logos are trademarks of FUTNext LTD. You may not use these trademarks without our prior written permission.

8.3 Your Content

You retain ownership of any data you input into the Service (e.g., tracking data, notes). By using the Service, you grant us a limited license to use this data to provide and improve the Service.

9. Privacy and Data Security

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9.1 Data Storage

Your health and tracking data is stored securely on our servers and encrypted in transit and at rest.

9.2 Data Backup

While we implement backup systems, we recommend premium users regularly export their data. We are not liable for data loss.

10. Disclaimers and Limitations of Liability

10.1 "AS IS" Basis

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free operation

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUTNEXT LTD SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Personal injury or property damage
• Failure to quit vaping or relapse
• Health complications related to nicotine use or withdrawal

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS LESS.

10.3 Jurisdiction-Specific Limitations

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless FUTNext LTD, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of third parties
• Any content you submit or transmit through the Service

12. Termination

12.1 Termination by You

You may terminate your account at any time by deleting your account through the app settings.

12.2 Termination by Us

We reserve the right to suspend or terminate your access to the Service:

• If you violate these Terms
• If your account is inactive for more than 24 months
• If required by law
• At our sole discretion with or without cause

12.3 Effect of Termination

Upon termination:

• Your right to use the Service immediately ceases
• Your data may be deleted after 30 days (unless required by law to retain)
• Premium users will not receive refunds for unused subscription time
• Provisions that by their nature should survive termination will survive (e.g., warranties, indemnification, limitations of liability)

13. Changes to the Service

We reserve the right to:

• Modify, suspend, or discontinue any part of the Service
• Change features, functionality, or pricing
• Impose usage limits
